1. The Service

iShe provides software tools and professional services that help independent creators distribute, promote, and track their promotional videos across multiple marketing channels. The service includes a dashboard, analytics, a link-in-bio tool (SmartLink), and manual distribution services provided by our team.

iShe is a software-as-a-service platform. We do not sell, publish, or profit from any specific content uploaded by creators. Our revenue is derived exclusively from subscription fees paid by creators for access to our tools and services.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use iShe. By using the service, you represent and warrant that you meet these requirements. Any individuals depicted in content uploaded to iShe must also be at least 18 years old at the time of recording.

3. Your Account

You are responsible for safeguarding your login credentials and for any activity under your account. Notify us immediately at hello@ishelab.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms or our Acceptable Use Policy.

4. Your Content

You retain full ownership of all content you upload to iShe. You grant iShe a limited, non-exclusive, worldwide license to store, process, and distribute your content to the marketing channels you select, solely for the purpose of providing the service. This license ends when you delete your content or close your account.

You represent and warrant that: (a) you own or have all necessary rights to the content you upload; (b) your content does not violate any law or any third party's rights; (c) any individuals depicted in your content are 18 years of age or older; and (d) you have obtained any required consents and releases.

5. Subscription & Billing

iShe offers several subscription tiers. When you subscribe, you agree to pay the recurring fee for the tier you selected. Subscriptions renew automatically until canceled. You can cancel anytime from your dashboard; cancellation takes effect at the end of the current billing cycle.

Payment processing is handled by third-party payment processors. iShe does not store credit card numbers or payment credentials. By providing payment information, you authorize us to charge the subscription fee to your chosen payment method.

6. Acceptable Use

Your use of iShe is governed by our Acceptable Use Policy. You agree not to use the service to upload or distribute illegal content, infringing material, content depicting minors, or any material that violates the terms of the destination platforms. Violations may result in immediate suspension or termination of your account.

7. Intellectual Property

iShe retains all rights, title, and interest in the iShe platform, including its software, design, and documentation. These Terms do not grant you any rights to use our trademarks, logos, or other proprietary elements without our prior written consent.

8. Copyright & DMCA

We respect intellectual property rights. If you believe your copyrighted work has been used on iShe in a way that constitutes infringement, please see our DMCA Policy for instructions on how to submit a takedown notice.

9. Disclaimer of Warranties

iShe is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee any specific level of audience growth, engagement, or revenue. The performance of your promotional content depends on many factors outside our control, including platform algorithms and the quality of your content.

10. Limitation of Liability

To the maximum extent permitted by law, iShe and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the service. Our total liability to you for any claim related to the service shall not exceed the amount you paid to iShe in the twelve (12) months preceding the claim.

11. Termination

You may close your account at any time. We may suspend or terminate your account if you violate these Terms, our Acceptable Use Policy, or if required by law. Upon termination, your access to the service ends and your content is deleted from our systems within thirty (30) days, except as required for legal or record-keeping purposes.

12. Governing Law

These Terms are governed by the laws of the jurisdiction where iShe is registered, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved in the courts of that jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, we will notify active users by email. Your continued use of iShe after changes take effect constitutes acceptance of the updated Terms.
